TERMS & CONDITIONS
By accessing this website and/or commissioning artwork from Malak (“the Artist”), you (“the Client”) agree to be bound by the following Terms & Conditions. These terms apply to all services, including custom canvas paintings, murals, and any related artistic work.
1. Orders & Acceptance
All orders are subject to acceptance by the Artist. A project is considered confirmed only after written approval of the concept, scope, pricing, and timeline, along with receipt of the required deposit or full payment. The Artist reserves the right to refuse or cancel any order at her discretion.
2. Pricing & Payment
All prices are quoted in AED unless otherwise stated. A non-refundable deposit (typically 30%–50%) is required to secure the booking, with the remaining balance payable prior to delivery or installation. Payments once made are non-refundable except in cases where the Artist cancels the project before commencement.
3. Custom Work & Revisions
All artwork is custom-made based on the Client’s specifications. Clients are responsible for reviewing and approving concepts, sketches, or digital previews before production begins. Reasonable revisions may be included at the concept stage; however, additional changes or changes requested after approval may incur extra charges and affect delivery timelines.
Due to the personalized nature of the work, cancellations are not permitted once production has started. Deposits are non-refundable. If a project is canceled before work begins, refunds (if applicable) will be at the Artist’s discretion, excluding any administrative or design work already completed.
5. Production & Delivery
Estimated timelines are provided as guidance only and may vary depending on project scope, revisions, material availability, and external factors. The Artist is not liable for delays caused by third-party services, including shipping companies or customs. Risk of loss or damage transfers to the Client upon delivery.
6. Shipping & Installation
Shipping fees (if applicable) are calculated separately unless otherwise agreed. The Client is responsible for providing accurate delivery details and ensuring appropriate access for delivery or installation. For murals, the Client must ensure the surface is suitable and ready unless preparation is included in the agreement.
7. Damages & Claims
The Client must inspect the artwork upon delivery. Any damage or defect must be reported within 48 hours with clear photographic evidence. Failure to notify within this timeframe may result in the claim being declined. Remedies may include repair or replacement at the Artist’s discretion.
8. Intellectual Property
All intellectual property rights, including copyrights, remain the exclusive property of the Artist unless otherwise agreed in writing. The Client may not reproduce, distribute, modify, or commercially exploit the artwork without prior written consent. The Artist retains the right to display and promote the artwork in portfolios, social media, and marketing materials.
9. Liability
The Artist shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the artwork or services. The Artist’s total liability, if any, shall not exceed the total amount paid by the Client for the specific project.
10. Force Majeure
The Artist shall not be held responsible for delays or failure to perform due to circumstances beyond reasonable control, including but not limited to natural disasters, pandemics, supply disruptions, or governmental restrictions.
11. Governing Law
These Terms & Conditions shall be governed and interpreted in accordance with the laws of the United Arab Emirates. Any disputes arising shall be subject to the jurisdiction of the UAE courts.
12. Acceptance of Terms
By placing an order or using this website, the Client confirms that they have read, understood, and agreed to these Terms & Conditions in full.
